Labor Unions Top Ten Special Privileges
Labor union officials enjoy many extraordinary powers and immunities that were created by legislatures and the courts. Union officials claim to rely on the support of rank-and-file workers. Yet, they clamor in the political arena to secure and expand their government-granted powers, including the powers to shake down workers for financial support and even to wage campaigns of violent retaliation against non-union employees.
The following list of special privileges reveals the extent to which union bosses have rigged our nation’s labor laws in their favor.
Privilege #1: Exemption from prosecution for union violence.
The most egregious example of organized labor’s special privileges and immunities is the 1973 United States v. Enmons decision. In it, the United States Supreme Court held that union violence is exempted from the Hobbs Act, which makes it a federal crime to obstruct interstate commerce by robbery or extortion. As a result, thousands of incidents of violent assaults (directed mostly against workers) by union militants have gone unpunished. Meanwhile, many states also restrict the authority of law enforcement to enforce laws during strikes.
Privilege #2: Exemption from anti-monopoly laws.
The Clayton Act of 1914 exempts unions from anti-monopoly laws, enabling union officials to forcibly drive out independent or alternative employee bargaining groups.
Privilege #3: Power to force employees to accept unwanted union representation.
Monopoly bargaining, or “exclusive representation,” which is embedded in most of the country’s labor relations statutes, enables union officials to act as the exclusive bargaining agents of all employees at a unionized workplace, thereby depriving employees of the right to make their own employment contracts. For example, the National Labor Relations Act (NLRA) of 1935, the Federal Labor Relations Act (FLRA) of 1978, and the Railway Labor Act (RLA) of 1926 prohibit employees from negotiating their own contracts with their employers or choosing their own workplace representatives.
Privilege #4: Power to collect forced union dues.
Unlike other private organizations, unions can compel individuals to support them financially. In 28 states under the NLRA (those that have not passed Right to Work laws), all states under the RLA, on “exclusive federal enclaves,” and in many states under public sector labor relations acts, employees may be forced to pay union dues as a condition of employment, even if they reject union affiliation.
Privilege #5: Unlimited, undisclosed electioneering.
The Federal Election Campaign Act exempts unions from its limits on campaign contributions and expenditures, as well as some of its reporting requirements. Union bigwigs can spend unlimited amounts on communications to members and their families in support of, or opposition to, candidates for federal office, and they need not report these expenditures if they successfully claim that union publications are primarily devoted to other subjects. For years, the politically active National Education Association (NEA) teacher union has gotten away with claiming zero political expenditures on its IRS tax forms!
Privilege #6: Ability to strong-arm employers into negotiations.
Unlike all other parties in the economic marketplace, union officials can compel employers to bargain with them. The NLRA, FLRA, and RLA make it illegal for employers to resist a union’s collective bargaining efforts and difficult for them to counter aggressive and deceptive campaigns waged by union organizers.
Privilege #7: Right to trespass on an employer’s private property.
The Norris-LaGuardia Act of 1932 (and state anti-injunction acts) give union activists immunity from injunctions against trespass on an employer’s property.
Privilege #8: Ability of strikers to keep jobs despite refusing to work.
Unlike other employees, unionized employees in the private sector have the right to strike; that is, to refuse to work while keeping their job. In some cases, it is illegal for employers to hire replacement workers, even to avert bankruptcy. Meanwhile, union officials demonize replacement workers as “scabs” to set them up for retaliation.
Privilege #9: Union-only cartels on construction projects.
Under so-called project labor agreements, governments (local, state, or federal) award contracts for construction on major projects such as highways, airports, and stadiums exclusively to unionized firms. Such practices effectively lock-out qualified contractors and employees who refuse to submit to exclusive union bargaining, forced union dues, and wasteful union work rules. So far, just three states have outlawed these discriminatory and costly union-only pacts.
Privilege #10: Government funding of forced unionism.
On top of all of the special powers and immunities granted to organized labor, politicians even pour taxpayer money straight into union coffers. Union groups receive upwards of $160 million annually in direct federal grants. But that’s just the tip of the iceberg. In 2001, the federal Department of Labor doled out $148 million for “international labor programs” overwhelmingly controlled by front group. Federal bureaucrats spend approximately $2.6 billion per year on “job training programs” that, under the Workforce Investment Act, must be administered by boards filled with union officials. Union bosses also benefit from a plethora of state and local government giveaways.

My name is George Mulligan I am a CSO in Vermont and the Former President of the UGSOA. I am writing to you about our experience with the UGSOA. Vermont was the first Union in the second circuit to affilate with the UGSOA, and the first Union to Disaffiliate with the UGSOA !
The members in vermont felt we were not being served by the UGSOA and Jim Vissar UGSOA President. When we called we were put off or received no response at all. Jim Vissar was never there to answer our questions even when we requested in writing to do so !
When we asked President Vissar to come to Vermont to answer our concerns there was always a reason why they could not come. There are still bitter feelings in Vermont about the UGSOA and their lack of leadership. In closing, I would urge every UGSOA Member to GET RID OF THE DO NOTHING UGSOA and if that don't work then STOP PAYING DUES TO UGSOA for a service they do NOT provide !
Vermont was the first Union in the second circuit to affilate with the UGSOA, and the first Union to Disaffiliate with the UGSOA !

Former UGSOA Local 52 Member Speaks out AGAINST UGSOA

We Were Sold-Out by UGSOA and Now We are Stopping the Dues !
I am a former UGSOA Local 52 member-To give you an idea--the Local President back in Oct., 2003 said that he had to invoke the "EMERGENCY RATIFICATION" Clause from the International Constitution--well so far I have requested for that same said Constitution and they are giving me the run around--I have personnally looked at a copy of it and went through it--and guess what can not be found--you guessed it--that same Clause--so I sent a letter to the UGSOA International asking where this "Emergency Ratification" Clause is located--this letter was sent e17th Jan., 2004--as of date no answer--I also sent emails (3 times requested)-- to the Local 52 President and to this date--I have not received any answer--what do they have to hide--except that the International is corrupt (Mafia ties) and can not be trusted--what have they done for us--except take our hard earned money--do you know that the 2002 Expenditure report for the International is off by $41,500 but they do not memtioned where it is--miling the books--

This UGSOA has violated employee rights at the San Ysidro Port of Entry They use the company, as well as themselves to force a union we never wanted or even voted for. They also threatened us with our employment. Michael Hough is the local 52 President and on the cimpanies side. Thanks to UGSOA, instead of getting $17.50/hr for training, we only get $6.75/hr. Miami, Fla. (April 6, 2004) ? Three security officers at the Miami Federal Courthouse hit United Government Security Officers of America (UGSOA) Union Local 131 officials with a lawsuit today for illegally ordering them to pay union dues to keep their jobs in violation of state law.
With free legal aid from attorneys,Cynthia Vitale and two coworkers filed the lawsuit in the Circuit Court of the 11th Judicial Circuit in and for Dade County, Florida. The security guards allege UGSOA officials? actions violated Florida?s Right to Work law, which prohibits the practice of forcing employees to join or pay dues to an Unwanted Union UGSOA for a Service they DON'T Receive.
?UGSOA officials? actions show they are more concerned with stuffing their coffers with union dues than respecting the rights of employees they seek to ?represent,?? said Stefan Gleason.
Beginning in May 2003, UGSOA union officials posted several notices at the Miami Federal Courthouse claiming all security officers were required to either join the union or pay a non-member agency fee equivalent to 95% of full union dues. Vitale and her coworkers assert that UGSOA officials used the notices in order to pressure security officers into the UGSOA union against their will.
Some of the notices also falsely claimed that the security officers worked on federal property and thus were not protected by Florida?s Right to Work law and could therefore be forced to pay union fees as a condition of employment. While it is true that those employed on ?exclusive federal property? are not covered by a state Right to Work law, only one such property exists in Miami, and Vitale and her coworkers perform the vast majority of their work on other properties.
?These bully tactics by Jim Vissar UGSOA President and James Carney UGSOA Vice President demonstrate why the vast majority of Florida workers are fortunate to labor in freedom and under the protections of a Right to Work Law,? stated Gleason.

My name is Challis Smith and I formerly worked for Special Operations Group in Charleston WV under contract with DHS. I was a member of UGSOA. I was unjustly terminated on Sept. 17, 2003. After months of stalling and lies by Jim Carney and Ron Smith, VPs for UGSOA, my case was finally arbitrated 1 year later. I won my arbitration and was ordered reinstated and to be made whole on Dec. 8, 2004. However, UGSOA refused to enforce the arbitrator's decision and I was forced to file charges with the NLRB. Now, 2 yrs later, the NLRB Office of Hearings and Appeals ruled in my favor stating that UGSOA was in violation of the NLRA. Why does our UGSOA President have to lie?
As a totally dissatisfied member of UGSOA, I am disgusted with the lies, half truths and lack of service to my fellow officers from our UGSOA union. Because of this I am sharing my research on accusations and claims being made by our invisible President J. Vissar. We are all fed up and prepared to get out of this worthless, dishonest union, and this in part is why!
Let's just start at the beginning of this year. In January our dishonest President put out a "letter to all UGSOA members" on the website. In it, Vissar makes several statements and accusations about other unions, so me and the some of the other officers checked out his claims.
Vissar said in his letter to us "last year, the SPFPA wanted to merge with us. We refused and so they tried raiding our locals." This made no sense to us as our investigation of the SPFPA union showed that they had over 20,000 members. Now why would a big union want to merge with our union of less than 4,000 (according to LM's)?
The truth is SPFPA wanted Vissar and the UGSOA to merge with them. They say to create a larger, more effective union to speak for everyone. That makes sense to us, but even if it didn't Vissar is still a liar! Why does our President have lie to us? Is it because we, as a union, are losing so many members because of his poor leadership? We have checked, and it's true. UGSOA locals in California, Florida, Missouri, Virginia, Washington, D.C., and others all want out, or to at least not have to pay dues for a service we don't get.
Vissar also said in his letter to us 'I would not spend our money to fight these rumors." Well, he sure isn't spending it to service us, so why not? I actually put in a call to see if I could get a response to my unit's feelings about UGSOA, and Vissar wouldn't even take my call, nor would he call me back. Is this what we pay for? I don't think so!
Just so you know, I was challenged to call the other union to see if anyone would talk to me. When the secretary answered the phone, I told her I was with UGSOA and wanted to speak to the President. Within minutes, a man named David Hickey answered the phone (the SPFPA President). He asked my name (which I refused to give), but he understood and asked "how can I help you today?" I'm not even in their union, and he's asking how he can help. Isn't that what our union should be asking? Apparently Vissar doesn't think so.
